Do we have to finish all the years in the original game first? Or can it be used with any of the years?

This game builds off of the original game plus the creatures expansion. You do not need to have won all the levels but you should probably own both Hogwarts Battles & the creatures expansion so that you have all of the cards you need.

The rules for villains of pack two say to include "both death eaters." i have the base game and monsters expansion but only have one death eater-typo?

No. There should be 2 death eaters from the original game. The 1st was in year 4 and I believe the 2nd was year 6.

Do you need to play the original one first?

Yes you do. It is an expansion to that game. PUTTING that aside, I absolutely LOVE the Harry Potter game and own all the expansions. You do NOT need to play with the first expansion with the second one. The first expansion is with the monster book of monsters and THAT one CAN be played on its own with the help of the characters from the original game. Both expansions only contain one new character. I know I wrote a lot of questions that you didn’t even have but it is my FAVORITE game!
