You need at least two people to play since two teams are needed. But I've played with multiple people even with having different number of people on each team and it works just fine. This is a cooperative game meaning everyone wins or everyone loses. So you are both trying to help each other to find all of the Order of the Phoenix people marked on both sides of the map card that you draw. If you have a big Harry Potter fan in the family I think you will like this game and you can draw on that HP lore to play the game better. Have fun.

It’s impossible to win because there are always 2 death eaters covering two order spots . what are we doing wrong ? do we both sit on the same side ?

There are two teams and you should never look at the side of the card of the other team. Looking at the card from your side there will always be one of your death eater spots that will be an order spot on the other team's side. In those cases you do not want the other team selecting that spot but for one the one spot that is an order spot on the other team's side you will have to choose that one from the clues that the other team gives. It is ok if you select a place on the board that is a death eater spot, it only matters what is on the card of the other team.

No. It is just themed with the Harry Potter license. However, there are other versions of the Codenames game that have no license.
