has anyone been affected by the chemicals as stated in the legal disclaimer?

A few things to understand there: 1) That disclaimer is for a CA law that requires retailers to disclose if a product contains "significant exposure" to products that cause cancer, birth defects, or other reproductive harm. 2) the term "significant exposure" is not defined. At all.. So most businesses just slap a prop 65 warning on basically everything containing any quantity of one of about 900 chemicals on the CA list of chemicals covered by prop 65. 3) most prop 65 warnings do not specify under what circumstances a chemical is harmful. In this case, probably only if ingested; or inhaled as a result of, say, sanding or grinding. 4) I live in CA. These warnings are everywhere, for damn near everything. You can safely ignore them 99.9%+ of the time.

The blade length is 38 inches (3' 2"). The length of the entire sword is a little over 48 inches (4').

can the hilt and guard be removed?

Yes the guard and grip can be removed and replaced. In fact someone used to make a stainless steel guard, but I haven't been able to buy it because they don't always show up or out of stock. I've replaced my grips at least once.
