I had no trouble with my case at all. It's filled with CD's and I store it in my car. Contact the seller and see if you can return it.

Q: Is this ok to leave in the car on a hot day?

Yes I got two of them. We live in Florida thay are in the arm rest and are just fine

Q: does this scratch the CDs?

No, the sleeves are flexible lightweight plastic. I have used similar CD holders for 15 years, and my earliest cases with sleeves are still like new.
